What Are The Laws Governing Marijuana?

In the State of Washington, the charges covering possession of marijuana are called VUCSA, which stands for Violation of the Uniform Controlled Substance Act. One of the controlled substances listed in these laws is marijuana.

The law states that if you possess less than 40 grams, (less than one and a half ounces) you could be charged with a VUCSA related misdemeanor, which is punishable by a maximum of 90 days in jail and a fine of up to $1,000.

Possession of more than 40 grams of marijuana is a Class C felony in the State of Washington. Class C felonies carry a punishment of up to 5 years in jail and a $10,000 fine. If you are found in possession of more than 40 grams of marijuana, you could be charged with the intent to sell, which can carry even more severe penalties.

Although possession of 40 grams or less is considered a misdemeanor, the sale, cultivation or delivery of any amount of marijuana can cause you to be charged with a felony instead of a misdemeanor. The penalties for selling within 1,000 feet of a school and for selling marijuana to minors are even harsher.

Possession of Marijuana (less than 40 grams) carries a mandatory minimum penalty of a $250 and one day in jail. The maximum penalty is 90 days in jail and a $1000 fine. If convicted of Possession of Marijuana you will likely also be ordered to get a drug evaluation and follow any recommended drug treatment.
