Can I Fish Without a License?

You cannot fish without a license in Washington State. In fact almost every fishing violation in Washington State is a crime. The most common charges that we’ve seen for Washington fishing violations are called the recreational fishing in the first degree or recreational fishing in the second degree. One of those charges, the second degree, just means you have too many fish or you have some wrong species of fish or you simply have a fish without a license. The maximum penalty for that charge is 90 days in jail. Now, recreational fishing in the first degree means you have double the amount of fish you’re supposed to have, and you can go to jail for a year for that charge. Years ago, you could just pay some money to make a fishing ticket go away. Now, you can’t do that. Now, you have to go to court. It’s treated the same as a DUI or a theft or even an assault.
